On Rights, Human Rights, and Property: A Response

چکیده
This article responds to papers by Joseph Bowen, Simon May, Zofia Stemplowska, and Nick Sage, focused on my monograph, Human Rights, Ownership, the Individual (OUP, 2019). The book develops a new account of nature rights: as duties governed ‘addressive’ norms first- second-personal thinking. has implications for both human rights property rights. It implies that in law should be founded pre-legal moral grounded how they serve individual right-holder. And it much property, which is morally only system serving collective goods, would beneficially reconceived non-rights terms. defends against Bowen’s May’s arguments rival ‘Interest Theory’, circularity charge. In response Stemplowska (who builds O’Neill), place goods services foundations socioeconomic view while are right-holder’s sake, most constituting wealth modern markets not – this throws doubt such property's status right.
